“Porn-Ban” or Child Porn Ban? Shameful Outrage of Morally Defunct Indians!

A couple goes into a mall with their 6 year old son and as the son is roaming in the store they are buying clothes from, he disappears.   They frantically search… and search.. and search.  But the kid is gone.  Yes, GONE!  Vanished into thin air.  As the police look for clues and close in on the suspects, they realize that the 6 year old was abducted.  By people who make Child Porn and share with their “friends” globally.  The child is kept in a small room, and to taunt the police, the offenders even upload nude videos of the kid in that room.

The police later find that the 6 year old kid who was abducted wasn’t the only one.  There are hundreds of thousands – girls and boys – who are abducted and USED to create Child Porn.  And, Child Porn is not just “simple” making nude videos and taking nude pictures.  But it includes all kinds of sexual abuse and torture, often resulting in death of the kids.

Imagine if this was YOUR kid.  Is that bearable?  If it was (don’t know how though) even when it was just any kid!

Thankfully this was from an episode of “Criminal Minds” and not a real life incident – although it is “inspired” by real world events.

The statistics of kids who are victims of child porn is mind-boggling even when they are mere estimates – which are decidedly very low.  Here is one.

Statistics for cyber child pornography are difficult to find but in her report M’jid points to estimates that over a three year period between 2001 and 2004 the number of sites carrying child pornography nearly doubled to around 480,000. Estimates of the number of children who are victims vary hugely, from ten thousand to 100,000. Pornographic images of children, from babies through to teenagers are posted on the web. Figures cited in the report estimate nearly 20 percent of individuals possessing child pornography had images of babies and children aged under 3 and more than 80 percent had images of children aged between 6 and 12. In India, child porn is ‘illegal.’  The Supreme Court of India has been asking the Indian Government to block sites which include child porn.

Even as technology bigwigs like Google and Microsoft are sitting up to take note and combat child sex abuse on the Internet, the Supreme Court of India (SC) has issued a notice to the Department of Telecom (DoT), seeking a response on how to block child pornography. (Nov 18, 2013 / Firstpost)

Despite the clear intention to block the sites with child porn, internet service providers discussed how difficult it was to carry out such measures.

In response to a PIL filed by Indore-based advocate Kamlesh Vaswani highlighting menace of child pornographic content freely available on the internet, ISPAI said, “It is impossible for an ISP to block pornographic sites without orders from the court or department of telecom (DoT). While ISPs are legally bound to comply with all orders to block pornographic or other websites as suggested by DoT, the task of identifying such websites ought not to be left to ISPs who lack institutional and logistical capacity to do the identification.” (Jan 28, 2014 / TOI)

Based on Supreme Court’s directive – which ruled on the petitioner Kamlesh Vaswani’s petition – the Indian Government blocked 857 sites included IN the petition.

The Real Situation?

The main reason for the action on “Porn Sites” (actually CHILD porn sites, small oversight eh?) was the Supreme Court directive based on a petition which mentioned those sites.  Why?  Because the petitioner thought they include child porn.

Of course, Child Porn is illegal in India as it RIGHTLY should be!

So, the action was (1) Based on existing law against child porn, which every parent (and human being.. actually even animals may join in) would want to be enforced, and (2) predicated on the sites included in the petition ruling on which was the trigger for sites blocking action.

So, was it “Porn Ban”?

These are facts.  But what was the “story” in the media, in the blogs, in social media?

“India bans porn!”.

The fascist Modi Government.  The Saffron Modi Government.  The prudish Modi government.  Bans 857 porn sites.

Just 857 SITES?!!!  Do you know how many porn sites are there on the internet??!!  Try Billions!!

857 out of BILLIONS?!!  Really?!!

If the Modi Government is indeed Fascist – then it is ridiculously incompetent in its fascist tendencies.  Because you know what?  If I was fascist and had to ban porn – I would go for 20 billion sites!  If I have to be a dictator, then why go for half measures?!  Almost sounds like an inefficient villain. Specially one who has been epitomized as THE Villain in India on social media!

And if I am such a puny and incompetent fascist…. then am I really a fascist after all?!!

The truth was that the action was against Child Porn.  Remember that 6 year old kid in the beginning?  Yes, those are the kids that fuel such sites.  It could be anybody’s kid, but as human beings if you and I cannot feel his and his parents’ pain, then we have no reason to even be protected by any law.  We OUGHT to be ruled by a dictator and a terrible one at that!!

Child porn sites were to be blocked.  A smart-aleck who thought he would do some public good by at least some action against child porn could only compile a small list.  Which itself was shoddily done.

Result: Some of the favorite porn sites frequented by Indians banned.

And, all hell breaks lose.

The heritage of Kamasutra is at stake.  Khajuraho’s culture is being threatened.

Is this what our culture is reduced to now?  Outrage against law enforcement action against child porn?  Yes, it wasn’t done well.  Yes, it was shoddily done.  But fascist?  Threat to our culture?  Our freedom?

Freedom?!!!

If that 6 year old in that room who was abused and videographed was your OWN kid, would you care of YOUR freedom to view porn… or HIS Freedom to LIVE?!

If the reason why you aren’t outraged by child porn is because the millions who are abused are not your kids, then you deserve no sympathy.  For, those who want from the humanity by the yard… but are only prepared to give by the inch… should be nicely KICKED by the FOOT!!

Moreover, just think of what has the mass outrage achieved in the end.  It has ruled out any serious action against Child Porn on the net in India.  By doing so, are we not backing the Child Porn criminals and abusers?  Are we not acting against the children who are being abused?  Before you go about expressing your outrage against a manufactured controversy, please see whose side are you on?  Because you may be setting a precedence that may make it impossible for anyone to enforce laws against Child Porn itself!  Of course you are free to like/vote/retweet whatever you want on social media and encourage whoever you want on TV, however shrill s/he may be.  But isn’t it time to go by your own intelligence and express your humanity instead?

 

Special Note from the Author:

Many people in some fora have argued about the “motivation” of the petitioner and how he has “no right to do so”.  The obvious hypocrisy of such an argument cannot escape a person who can apply him/herself just a bit.  Nevertheless, here is my response.

Whatever may have been the motivation of the lawyer for filing the suit, one thing needs to be clear – it is his RIGHT to file a petition if he feels strongly about it.  Just as his critics have the right to file a petition to make Porn a Fundamental Human RIght to be included in the Indian Constitution. 
To call him names, to brow-beat him and deny him HIS Right of Expression, while establishing your own is the sine qua non of FASCISM!  He has a legal right… he exercised it.  You have the same right.. go exercise it as well.  Stop bringing him down for his right to express himself!  Just learn to deal with a MULTI-CULTURAL society.  Linear Moral arguments are the foundation of a fascist society.  Which is what the “Right to Expression” activists seem to be veering this whole society towards.  Is that so difficult to see?

    Half of the problems created in India are because of media. I think they have too much freedom to type whatever they like. People read that and they react. Media these days are just bothered about selling stuff and not about the authenticity of the news that they publish. Especially biggies like Toiletpaper Of India (TOI).

    Very well written. I have been arguing with my adarsh liberal friends/acquaintances about this ever since this became a “Breaking News”.
    The sad part is media gave priority to this, (which by the way has happened before during Congress rule, some time in July 2013) rather than to the actual news of US asking ISRO to launch it’s satellite.
    In their vested interest some people are hell bent on defaming current govt. and projecting a sorry state in the eyes of foreign countries.

Despite some amazing work by folks in India, what happens – and it is by design of the “powers-that-be” – to be in the media is trash. Irrelevant trash at that. But one thing is for sure… people have an amazing level of commitment and love for porn in India – at least that’s established!

    Very well written Desh. The numbers are mind boggling … I feel media has been taking it’s freedom of expression for granted and that’s affecting the society in a negative way. There has to be some punctuation to this. The sad part is, people just go with the flow without even thinking or questioning.

    i for one have a very low opinion of our civil society activists, and most of them including media get, wittingly or unwittingly, easily manipulated. having been part of the system for over thirty five years i know that every government action is half-baked and half-planned, but we have to live with this system. improvements are always incremental and often by hit and trail. but activists don’t want to accept this reality because they have their own agenda.

      IB-ji – I share your contempt for these rent-a-cause activists strutting around in India as the “moral voice” of the masses, when they aren’t. We all know Govt. everywhere is inefficient. I have been in the US and I know how inefficient the US Govt departments are. But as long as they are addressing the right issues, we can work patiently and intelligently to get the right laws and enforcements in place. A tough call even that these days apparently! And the jokes on you. All the site themselves monitor child porn as it is illegal all around the world. The kid might have been abducted but he never featured in the 857 sites for sure.

    I always thought my husband was too overprotective about out kids, but it seems he knows the society better. The world is becoming a strange place – when I was small no one would even think of watching whether we were safe when playing at the playground or going to the nearest shop to buy some ice-cream.

    Have you found child porn at the blocked sites? If not, then your stuff is nothing more than sensationalist rantings of a morally fascist lunatic. Because all you care to do is to control and dictate other peoples’ behaviour based on your own sensibilities. No one is asking you to watch porn. But unless you can connect your ‘child disappears’ story to a site that explicitly carries childporn, STFU! How is SavitaBhabhi connected to childporn?

I have addressed the shoddiness of the list and also why it doesn’t detract from the real purpose of the petition. But that would need someone to take his face out of your arse and read. You use emotive issues like child porn to push ideological agendas. Nobody really knows the ‘real purpose’ of the petition, but we can all see the govt’s response.           The aim was to block Child Porn. That was the notice issued by SC to DOT. So in your highly emotive defense of your love for porn you missed this small print – “Child”.

          Like I said you have an ideological axe to grind of your own and can’t get your head straight. So dude, lets cut the crap here will ya? If you have any facts ON THE SUPREME COURT order (which are contrary to what has been reported already!) – lets talk about that. Otherwise your rants and frothing from the mouth ain’t cute anymore. Your heart break over the loss of Freedom to enjoy your favorite porn (including Savita Bhabhi) nothwithstanding!

Much as I may love porn, my ‘highly emotive’ defence is of preserving personal freedoms, of my right to watch. But clearly such nuances are lost on you. Crap is this: Unless you can find child porn at Savitabhabhi, you may as well ban shaadi.com or Amazon to achieve that goal. What does one have to do with the other?? Of course, one should be concerned about Child porn. Afterall, India ranks quite high on the child exploitation scale.           I doubt you have gotten the facts about the case and you keep on arguing from your ideological perch throughout.

          Just get one thing clear – no one is taking away your oh-so-necessary-freedoms-of-porn. That is the reason the list of sites was revised. The guy – attorney who put in the petition may not have been as great an expert on porn sites as you are, but his intention of targeting Child Porn for public good was laudable.

          What is astonishing is that instead of doing something about Child Porn – like say making a list of sites which actually do that and petitioning in the SC to alter the order, you are (1) going after the attorney .. or (2) the list of sites.

          Either you are porn addict who can’t get past the daily doze of porn and can’t think straight when you can’t find your Savita Bhabhi on your pc.. or your platitudes on Child Porn are insincere!

          I am very clear – if menace like Child Porn has to be acted against – we need to bolster and not diminish the actions / PILs / judgments against that – irrespective of how inefficient the attempts.

          Also, I am very clear that if we target any action of blocking sites in an action against Child porn simply on the pretext that some of them do not have Child porn – then we are creating a higher barrier to action against Child porn. And in that, we are helping the Child Abusers not hurting them. We are giving them a safe passage.

          The list needed to be BETTERED not thrown out! The DUTY of improving the action was needed not rants on RIGHT to porn!

          I doubt you will realize what you are doing and what you are saying and if it actually aligns with your values or not.

What bulls**t is this? Can you solve for anything by banning its display in a few places? And you have the gall to call that ‘going after child porn cartels’? Who is going after the attorney? I’m going after this self-serving and self aggrandising stupidity that seems to plague this whole thing. Offering a list of child porn sites to block…now that’s something valuable you should offer instead of hollow arguments. But that would require you to first start looking for them. Porn industry is exploitative and often includes content that can be tried as a crime (voyeurism and hidden camera videos, for example). IN developing
            countries, porn industry mostly uses prostitutes as models. Many of these prostitutes are abused and often pushed into what they do against their will. So for a few moments think and let me know again – are you for EROTICA or PORN?

          PS: Collective Social Morality is a Vector that formulates over time based on interactions between diverse moral compasses. Each voice needs to heard and given equal weight by design! You can read it on HT (http://www.hindustantimes.com/india-news/meet-kamlesh-vaswani-the-lawyer-behind-india-s-porn-ban/article1-1376265.aspx) His interest can easily be gauged by his track record…whether he has even an iota of interest in the subject, or if this is simply a prejudicial vehicle for ideology-driven action and fame. According to his petition, he connected dots from rapes of women to porn to child porn. Only in India does that logic even fly. The government, in their infinite wisdom, used that excuse to ban adult porn sites…something they have been itching to do for a while. Their mouthpieces proceeded to make an ares of themselves explaining it in the media. Because that logic made them a F-ing laughing stock world over yet again, they backtracked. But then rightwing armchair ‘intellectuals’ like you step forward to postrationalise this BS. You’re absolutely right about intolerance, but there’s nothing ‘self-righteous’ about it because it’s reactive to stupidity.           Dude, if you want to live in a democracy LEARN how democracy works! Your motives, your history, who you sleep with, what your religion is, what your vocation is, what your pet fetishes are, what your favorite love-making position is, who your parents are, or what you go after – DO NOT MATTER when it comes to GETTING RIGHTS UNDER CONSTITUTION! Vaswani – the devil incarnate that he is – HAS EQUAL RIGHTS UNDER LAW as “Gods Own Shit” Vineet has. Just Effing LOVE WITH THAT.. ok? It hurts I know for someone whom some asshole God comes to talk to, but thats how a democracy works!

          Now, my title – Yes I used the word “Morally Defunct” because I had no other word to showcase the perfidy and the basic lack of humanity / intelligence when people deal with the issue of Child Porn and how that issue was OBFUSCATED by making it about porn. I HATE the word “Morality” and I thought a lot before I used it. I’d rather have not used it but given the pithy nature of the title I couldn’t have explained my entire construct. Something I explained in the article… which you obviously missed – because you were busy jerking off on the side!

          You have all the rights – as long as what you are doing is LEGAL! What you are watching ISN’T a PRODUCT of a crime! As long as the actors are professionals and getting paid and getting all the precautions – sure, go and enjoy multiple orgies. Its worth it.

          Fascism in its purest sense is exercise of power where all dissent is pushed out by usurping the rights of others to exercise freedom of expression.

          So, smart-ass – just like you have freedoms, Vaswani ALSO has freedoms. By ascribing motives to him while hiding yours and taking away his rights under “god given” shit is fascism it is purest sense! You won’t get it because you get to talk to the God-damned Old man himself! Next time he pays a visit to you to give you some more rights, ask him on this will ya?

And if people want to preserve them they should also have to petition?? That’s one helluva moronic argument.     Child pornography is despicable. I do not have problem watching porn as long as people watching them have control over their instincts and urges. Unfortunately, in our country lethal combination of alcohol drinking and porn watching go together in many all male gatherings. The result can be disasterous for other members of society. I think to enjoy freedom and rights, one has to be responsible. There has to be many systems in place in society. I think there has to be a way to regulate how one can access porn. People protesting against porn ban are may be 300 million. Another 700 – 800 million Indians have no clue what the debate is about. They are more busy eking a livelihood and protecting their daughters, sisters and wives from the roving eyes of goons high after watching porn and consuming alcohol. I do not agree with ban. May be it is not feasible. But society has to decide what is more important liberty or safety.

    I think the author has only two points worth considering. That child porn should be banned in all forms and that the current ban was shoddily done, actually very very very pathetically done and even that is an understatement.

    When was the last time, you’ve been on a porn site? You seem to make the assumption that the majority of the big porn sites and majority of the porn viewers are all running around with the intention of viewing or displaying child pornography. Let me set this straight for you. We aren’t.

    The big porn websites take the child porn issue very seriously and block them as much as they can. And those that they miss out? The porn viewing community, yes that’s right, normal hardworking people like you and me who just wanna wind after a long day, will takes efforts of their own to report such offensive content. Just a bunch of reports is enough for the website moderators to view the content again and block it if deemed offensive. To top it off, google, yes you heard that also right, Facebook, YouTube, Vimeo etc also play their major roles in blocking violent and offensive content and have dedicated teams to do the same. Same actually goes for the torrent hosting websites, who while hosting pirated torrents, are against child pornography.

    Your buddy, the idiot of a lawyer, seems to fight a lie based crusade against porn in general. If you don’t believe me, read his quotes. He is a lawyer who never does his homework and is a poor excuse of a lawyer and I would recommend nobody hire him if he’s going to collect information this way.

    Child pornography is highly circulated using underground websites, deep web being the actual term for it. It’s not accessible through google or your normal browser. Deep web is huge and is the criminal hive of the Internet. And to put it this way, anything on the deep web can only be shut down if you go against the people who host it themselves, which is what the FBI is doing at the moment and which is what th cyber crimes division should be doing.

    The ban was sought on PORN which includes Child Porn…at-least get your facts right, ..and the government banned them because it wanted to Ban Porn , not just child porn….you seem to confuse between the two
    Let me give you an analogy
    —Drunk driving should be banned….hence if a court decided to ban Driving itself and people protest, you shamefully start saying they are supporting drunk driving…
